14.6 Approval of electronic communications. By using websites and/or services, you accept the receipt of certain e-mail messages from us, as stated in our privacy policy. Please read our privacy policy to learn more about our electronic communication practices. You agree that all communications, agreements, advertisements or other communications that we transmit to you electronically meet all legal communication requirements, including the written communication of these communications. DigitalOcean is a global company. We may transfer personal data to countries other than the country where the data was originally collected. These countries may not have the same data protection laws as the country in which you originally provided the information. When we transfer your personal data to other countries, we will protect this information as described in this Privacy Policy. Websites and services may contain links to third-party websites, services or other resources on the Internet, and third-party websites, services or other resources may also contain links to our websites and services. If you access third-party resources via the Internet, you do so at your own risk. These third-party resources are not subject to our control and, to the extent permitted by law, we are not responsible for the content, functions, accuracy, legality, adequacy or other aspects of these resources. The inclusion of such a link does not imply our approval or any link between us and third parties. To the extent permitted by law, we are not directly or indirectly responsible for the damage or losses caused or allegedly caused by or in connection with the use or trust in these third-party resources.

We also allow some vendors to make vendor offers available on the DigitalOcean Marketplace (providers and “supplier offers” are defined in the terms and conditions of the DigitalOcean Marketplace). The use of vendor offers may require you to agree to certain terms and conditions directly with the supplier, and DigitalOcean may not be a party to such a contract. It is your responsibility to protect your system from risks such as viruses, worms, Trojans and other security risks that may be represented by the resources or third-party offers described in this section. For more information on data processing, see DO: “European Data Protection Act” means (i) the European Parliament and Council Regulation 2016/679 on the protection of individuals with regard to the processing of personal data and the free movement of such data (General Regulation on Data Protection); and (ii) Directive 2002/58/EC on the handling of personal data and privacy in the area of electronic communications and applicable national transpositions (at least in their modification, replacement or redemption). The RGPD applies to all entities and persons established in the EU, as well as to entities and individuals, whether established in the EU or not, who deal with the personal data of EU persons. 13.4 A party intending to seek arbitration must first send a written notice of the dispute by a certified U.S. party to the other party.
